Please read these Terms of Use carefully and in their entirety before using gDetective.com(hereinafter referred to as the “Site”). The Site and its content are owned by gDetective LLC.
PURPOSE: These Terms of Use are here to clearly explain, outline, and layout the rules, terms, and conditions of using, viewing, and/or browsing the Site and/or purchasing or downloading any services, reports, digital materials, or products offered on or through the Site.

These Terms of Use contain an Arbitration Clause and require you to dispute or resolve any claim with us through Arbitration. By agreeing to these Terms of Use, you agree to the Arbitration Clause in Paragraph No. 18 and voluntarily waive your right to a jury trial.

“Content” means any and all written, visual, video, or audio information contained on the Site, including, but not limited to, any and all emails received from Jeffrey L Evensen, gDetective LLC, and/or gDetective.com, and any and all written or downloadable material purchased, viewed, or otherwise offered by gDetective LLC and/or on gDetective.com, including, but not limited to, blog posts, graphics, newsletters, designs, documents, information, templates and materials.
“Personal Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person, or to identify an individual in context. For example, personal information includes, among other things, your name, address, email address, telephone number, etc.
“Site, Services, and/or Products” means gDetective.com, Content (as defined herein), email list/newsletters, social media posts, blog posts, genealogy services, research services, DNA analysis services, guides, reports, eBooks, templates, website materials, and digital resources available on the Site.
“Site” means gDetective.com and any and all of its associated pages, tabs, landing pages, forms, or sub-pages.
“You” or “Your” means the user, customer, or viewer of the Site.
2. Consent:
By using the Site and/or making any Purchase, you implicitly and voluntarily agree to act in accordance with, and abide by, these Terms of Use, our Privacy Policy, and Disclaimer.
By using the Site and/or making any Purchase, you represent and warrant that you are at least 18 years-old. Any use of, or access to, the Site and its Content by anyone under the age of 18 is unauthorized and in direct violation of these Terms of Use and our Privacy Policy.

- Copy, download, share, post, or transmit our intellectual property in any way that infringes on our intellectual property rights.

By using the Site and/or making any purchase, you agree to these Terms of Use, our Privacy Policy, and our Disclaimer, each of which is incorporated herein by reference.
The information and services provided on this Site are for informational and educational purposes only and are provided “as is” without warranties of any kind. We do not guarantee the accuracy, completeness, or results of genealogical research or DNA analysis.
gDetective LLC provides historical and genealogical research services. Research results are based on available records and current methodologies. We do not guarantee that specific ancestors, relationships, or documentary proof will be discovered.
Any genealogical research or consulting services provided by gDetective LLC are subject to a separate written agreement. Nothing on this Site constitutes a binding service contract. Genealogical research findings represent professional opinions based on available evidence and may change as new information becomes available.
5. Your Consent to These Terms of Use:
By using this Site, or Purchasing or Downloading from our Site, Services and/or Products, you implicitly and voluntarily agree to these Terms of Use as stated herein.
6. Changes To These Terms of Use:
We reserve the right to change, amend, or otherwise alter these Terms of Use at any time without notice to you. When changes are made to these Terms of Use, we will update the “Updated on” date at the bottom of this page. If you do not agree with these Terms of Use, please do NOT use our Site, read or implement its Content, or Purchase or Download anything from us.

Typically, these URL links are provided so that you may directly access a site that contains relevant information. Please note we are not liable for any of the information contained on or within the third-party or external websites. The Site and its Content are protected by United States copyright and trademark laws, as well as state intellectual property laws. Any violations of this term, and all terms contained herein, will be legally pursued to the fullest extent permitted by law.
9. Our Limited License to You:
By accessing or using the Site and its Content, you are granted a limited, non-exclusive, non-transferable, revocable license for your personal, non-commercial use only.
All Content on the Site—including text, reports, images, graphics, designs, downloads, and other materials—is the property of gDetective LLC and is protected by United States copyright, trademark, and other intellectual property laws.
This limited license allows you to view, access, and use the Content for personal reference or informational purposes only. You may not copy, reproduce, modify, distribute, publish, display, transmit, create derivative works from, sell, or exploit any Content, in whole or in part, without our prior written permission.
You agree not to use the Site or its Content in any manner that is unauthorized, unlawful, contrary to these Terms of Use or our Privacy Policy, or that violates any applicable intellectual property or other laws.
We reserve the right to revoke this license at any time if you violate these Terms of Use.
10. Your License to Us:
By commenting on the Site, or submitting documents to gDetective LLC via contact form, email, or social media, you represent that you are the lawful owner of said documents, statements, and/or the information they contain. You grant us a license to use your comments or submissions in any way we see fit, as it relates to our business purposes.
11. Purchase & Access Terms:
If you purchase services, reports, or digital materials through the Site, you agree that any materials provided to you are for your personal use only, unless otherwise agreed in writing.
You may not copy, reproduce, distribute, share, publish, sell, or transfer any purchased or downloaded materials, in whole or in part, except for your personal reference or as reasonably necessary for your own family, legal, or personal use. Any commercial use or broader distribution requires our prior written permission.
If access to purchased materials is provided through a password-protected area, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to take reasonable steps to prevent unauthorized access, sharing, or distribution.
We reserve the right to suspend or terminate access to purchased materials if these Terms of Use are violated. Unauthorized use or distribution may result in legal action to the fullest extent permitted by law

Any and all current or past-client testimonials, statements, or examples used by us are simply that: examples. They are not guarantees that you will also experience or receive the same results. Each client and his/her circumstances are unique and nothing shall be interpreted as a guarantee that you will experience the same results as another client of ours.
14. DISCLAIMER - No Warrantees, Guarantees, or Representations Are Being Made:
All information, content, and services provided through the Site are offered on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, to the fullest extent permitted by law.
gDetective LLC makes no warranties or representations regarding the accuracy, completeness, reliability, availability, or suitability of the Site, its Content, or any services or materials provided. We expressly disclaim all implied warranties, including but not limited to warranties of merchantability and fitness for a particular purpose.
15. Your Release of Us:
By using the Site, its Content, or any services or materials provided by gDetective LLC, you agree that your use is voluntary and at your own risk.
To the fullest extent permitted by law, you agree to release and hold harmless gDetective LLC, its members, employees, contractors, agents, and affiliates from any and all claims, demands, or causes of action arising out of or related to your use of the Site, its Content, or your reliance on any information obtained through the Site.
This release does not apply to claims resulting from gross negligence, willful misconduct, or violations of applicable law.
16. Errors & Omissions:
Every effort is made to provide up-to-date accurate information both on the Site and through our services. However, due to the complexity of the issues we cover, gDetective LLC does not and cannot warrant, represent, or guarantee that such information is free from errors, accurate, or up-to-date at all times. You should do your due diligence, research, or consult with a professional to ensure that all information you receive, act upon, or rely on from this Site and/or from our services is accurate and up-to-date.
17. Our Refund Policy:
Due to the time-intensive and custom nature of genealogical research and related services, refunds are not provided for services that have already been performed or for work already delivered.
Fees and refund terms for genealogical research or consulting services are governed by a separate written service agreement, where applicable.

18. Arbitration Agreement; Class Action Waiver:
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Agreement to Arbitrate. You and gDetective LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use, the Privacy Policy, the Site, or your use of any services, reports, or digital materials purchased through the Site (collectively, “Disputes”) shall be resolved exclusively through binding arbitration, rather than in court, except as provided below. This agreement to arbitrate is intended to be broadly interpreted.
Arbitration Rules and Process. The arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by this Agreement, which are available at www.adr.org. The arbitration shall be conducted by a single arbitrator. Unless the parties agree otherwise, the arbitration shall take place in Jackson County, Missouri, or, at your election, may be conducted via telephone, video conference, or written submission. The arbitrator shall apply Missouri substantive law and shall have authority to award any remedy available at law or in equity, subject to the limitations set forth in these Terms of Use. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Fees. The AAA’s filing fees shall be allocated in accordance with the AAA Consumer Arbitration Rules. Each party shall bear its own attorneys’ fees and costs unless the arbitrator determines that a claim or defense was frivolous or brought in bad faith, in which case the arbitrator may award attorneys’ fees and costs to the prevailing party.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party’s intellectual property rights or confidential information. Either party may also bring an individual claim in small claims court in Jackson County, Missouri, provided the claim qualifies under that court’s jurisdictional limits.
CLASS ACTION WAIVER. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND GDETECTIVE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration agreement shall be null and void.
Jury Trial Waiver. BY AGREEING TO ARBITRATION, YOU AND GDETECTIVE LLC ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
19. Consent to Governing Law:
These Terms of Use, and any dispute arising out of it, shall be governed by the laws of the State of Missouri.
20. Consent to Jurisdiction:
You hereby irrevocably consent to the exclusive jurisdiction and venue of any Federal Court in the United States District Court for the District of Missouri or a state court located within the State of Missouri in connection with any matter arising out of these Terms of Use, Privacy Policy, Disclaimer, or as a result of your use, Download, or Purchase from the Site, Services and/or Products.
21. Consent to Service:
You hereby irrevocably agree that process may be served on you in any manner authorized by the Laws of the State of Missouri for such persons, and you waive any objection which you might otherwise have to service of process under the laws of the State of Missouri.
22. Payment & Purchases:
When you purchase or download any services, reports, or digital materials through the Site, you may pay by credit card, debit card, or other payment methods made available at checkout.
By submitting your order, you authorize gDetective LLC to charge the payment method you provide for the amount due. You will receive an electronic receipt following your purchase, which you should retain for your records.
If you elect the installment or “pay over time” option at checkout, you authorize gDetective LLC to charge your payment method for the amounts and on the dates disclosed at the time of purchase.
Payment processing companies may have different privacy policies and practices than we do. We are not responsible for the policies of the payment processing companies. As with any online purchase, there are circumstances beyond our control which may compromise your credit card or payment method. We are not liable or responsible for any of those circumstances.
You hereby release us from any and all damages related to your payment or use of our payment processing companies in which you incur and further agree not to assert any claims against us or them for any damages which arise from your Purchase or use of our Site and its Content.
23. Limitation of Liability:
gDetective LLC is not responsible or liable in any way for any and all damages you receive directly or indirectly from your use, Purchase, or Download from our Site, Services and/or Products. We do not assume liability for damages, injuries, harm, death, misuse of (or failure to properly use) information or documents, due to any act, or failure to act, by you. Notwithstanding anything to the contrary contained herein, your sole and exclusive remedy for negligence, failure to perform, or breach by us shall be a refund of the amount paid for such service or product. IN NO EVENT SHALL WE BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES. This limitation of liability does not apply to claims arising from gross negligence, willful misconduct, or where prohibited by law.
24. Defense & Indemnification
You agree to indemnify, defend, and hold harmless gDetective LLC and its members, employees, contractors, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
(a) your use of the Site or its Content;
(b) your violation of these Terms of Use, the Privacy Policy, or any applicable law; or
(c) any content, information, or materials you submit, transmit, or provide to us.
This indemnification obligation does not apply to claims arising from our gross negligence or willful misconduct.
25. Termination of Your Use
At our sole discretion, we are permitted to terminate your use or access to the Site, Services and/or Products, and Purchases/Downloads if you abuse, violate, or breach any of these Terms of Use, Privacy Policy, Disclaimer, or any other terms to which you have agreed to.
26. Entire Agreement
These Terms of Use, our Privacy Policy and Disclaimer, constitute the entire agreement between you and us with respect to the Site, Services and/or Products, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us with respect to the Site, Services and/or Products.
27. Severability
The provisions of these Terms of Use are severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision herein. If any paragraph, section, subsection, sentence, or clause of these Terms of Use are rendered illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall have no effect on these Terms of Use as a whole or on any other paragraph, section, subsection, sentence, or clause herein.
